    • de copier, distribuer, prêter, louer ou mettre à disposition le Logiciel ;
    • de le décompiler, de le désassembler ou d'en extraire les modèles ;
    • de contourner ses mécanismes d'authentification ou de traçabilité ;
    • d'en publier les listes de Candidates.

Article 4 — Compte personnel

  2. Données traitées :
    • l'adresse électronique et le nom ou pseudonyme du Compte ;
    • l'acronyme de catalogue déclaré ;
    • une empreinte anonyme des appareils utilisés ;
    • le journal d'exposition et d'actions de l'article 6, dont les sélections du point 6.6 et l'empreinte et les mesures des clichés personnels analysés, et la version du Logiciel.

    Aucune autre donnée n'est collectée : ni localisation, ni contenu des fichiers personnels, ni images de l'Utilisateur, qui restent sur son ordinateur.

PNHunter end-user licence agreement

Version 0.6 · beta. This is the agreement every user accepts in the application. It has not yet been reviewed by a lawyer. Questions: contact@pnhunters.org.

English translation for information. Only the French version is binding; in case of discrepancy, the French version prevails.

Preamble

PNHunter (hereinafter "the Software") is a tool for searching public astronomical surveys for uncatalogued planetary nebulae. It includes detection, AI-assisted triage, acquisition planning, preparation of submission dossiers and estimation of confirmation spectroscopy. The Software is designed and published by its author (hereinafter "the Author"), who can be reached at contact@pnhunters.org.

The Author makes the Software available free of charge to the amateur astronomy community. In return, he asks that discoveries made with the Software cite the tool that made them possible. This agreement sets out that return, without claiming anything over the discoveries themselves, which belong to their discoverers.

By creating an account, the user (hereinafter "the User") declares that they have read and accepted this agreement in full.

Article 1 — Definitions

Article 2 — Purpose

This agreement defines the conditions under which the Author grants the User a right to use the Software, and the User's obligations regarding the attribution of Discoveries.

Article 3 — Licence granted

  1. The Author grants the User a personal, non-exclusive, non-assignable and non-transferable right to use the Software, for non-commercial use, for the duration of the agreement.
  2. The User acquires no ownership right over the Software, its code, its artificial-intelligence models, its data or its documentation. They remain the exclusive property of the Author.
  3. Except where the law provides otherwise, the User shall not:
    • copy, distribute, lend, rent or make the Software available;
    • decompile or disassemble it, or extract its models;
    • circumvent its authentication or traceability mechanisms;
    • publish its lists of Candidates.

Article 4 — Personal account

  1. Using the Software requires creating an Account with a valid email address.
  2. The Account is strictly personal. The User must not share it, nor allow a third party to use the Software under their identity. The User is responsible for any use made with their Account.
  3. The number of devices on which an Account can be used is limited; the limit is stated in the Software.

Article 5 — Online operation

The Software must connect regularly to the Author's server to authenticate the Account and transmit the log described in Article 6. Temporary offline use is tolerated, within the limit stated in the Software. Beyond that, the Software may suspend access to Candidates until the next connection.

Article 6 — Traceability and priority

The User is informed and accepts that, in order to establish the priority of detections and the attribution of Discoveries:

  1. Detection register. The Software records on the Author's server each Candidate it detects: position, date and measured characteristics.
  2. Exposure log. For each Account, the Software records the Candidates displayed to the User and the actions performed on them, with date and time. The actions concerned are viewing a record, checking against exposures or plates, analysing personal images attached to a Candidate (their digital fingerprint, their date and the resulting measurements, never the images themselves), preparing a dossier and exporting data.
  3. Timestamping. The register and the log are timestamped daily by a third party, which makes it possible to establish that they have not been modified afterwards.
  4. Exact positions. Positions displayed, copied, exported and included in submission dossiers are the exact positions measured by the Software. They carry no marking.
  5. Signed dossiers. The submission dossiers produced by the Software carry an electronic signature and a mention of the Software.
  6. Priority arbitration between Users. When a Candidate reaches strict or nearly strict selection in the Software, this selection is recorded and timestamped on the server, and the Author is informed. If several Users find the same object, the Author can thus establish which one selected it first and assert it for the benefit of that discoverer, in particular with the HASH database. In return, the Author undertakes to use this information only for that purpose and for the defence of the rights provided for in Article 7: he does not publish it, does not communicate it to any third party outside an attribution dispute, and does not submit or observe for his own benefit a Candidate selected by a User.

These elements may be produced by the Author to assert his rights under Article 7, or those of a User under point 6.

Article 7 — Attribution of Discoveries: citation

For any Discovery concerning an Object from the Software, the User undertakes to comply with the following obligations. The User remains entirely free to name their Discoveries as they wish.

  1. Citation. The User explicitly cites the Software in the Discovery and in any subsequent communication or publication relating to it, in the following form, or any equivalent form requested by the Author:
    "Candidate identified with the PNHunter software (pnhunters.org)."
  2. Declaration to HASH. When submitting to the HASH database, the User states in the submission that the object was identified with PNHunter.
  3. Collective Discoveries. If a Discovery involves several people, for example an imager and a spectroscopist, the User informs their co-authors of these obligations and ensures that the citation is respected.
  4. Duration. These obligations apply to Objects from the Software worked on during the term of the agreement. After the agreement ends, whatever the cause, they remain applicable for three years, and only for those objects.

Article 8 — Breaches

In the event of a breach of Article 7, or of sharing the Account or the Software, the Author may, after inviting the User to remedy the situation:

Article 9 — Liability and warranties

  1. The Software is provided "as is". Candidates are hypotheses to be checked: they may be artefacts, known objects or objects of another nature. The Author guarantees neither the accuracy, nor the completeness, nor the novelty of the Candidates.
  2. The Software's estimates (exposure times, spectroscopy, observability) are indicative.
  3. The User is solely responsible for their observations, submissions and publications, and for complying with the rules of the databases and journals they address.
  4. The Author cannot be held liable for any indirect damage related to the use of the Software, within the limits permitted by law.

Article 10 — Personal data

  1. Data controller: the Author of PNHunter, who can be reached at contact@pnhunters.org.
  2. Data processed:
    • the Account's email address and name or pseudonym;
    • the declared catalogue acronym;
    • an anonymous fingerprint of the devices used;
    • the exposure and action log of Article 6, including the selections of point 6.6 and the fingerprint and measurements of the personal images analysed, and the Software version.

    No other data is collected: no location, no content of personal files, no images of the User, which stay on their computer.

  3. Purposes: authenticating the User; preventing Account sharing; establishing the priority of detections and the attribution of Discoveries; asserting the Author's rights under Articles 7 and 8.
  4. Legal basis: the performance of this agreement, and the Author's legitimate interest in having the attribution of his tools respected.
  5. Retention period: 10 years after the last connection, given the usual time needed to confirm and publish Discoveries. The log relating to an object that has been the subject of a Discovery may be kept until any dispute is settled.
  6. Recipients: the Author only. The data is hosted by Cloudflare, Inc. It is neither sold nor transferred. It may be communicated to the HASH database, the CDS, a journal or an authority, solely within the framework of Article 8.
  7. User rights: access, rectification, restriction and portability, and objection where provided for by law. They are exercised at contact@pnhunters.org. The User can view their log at any time in the Software ("My history"). A request for erasure may be limited for elements necessary to establish, exercise or defend legal claims, in accordance with the GDPR. The User may lodge a complaint with the CNIL (French data protection authority).

Article 11 — Term and termination

The agreement takes effect when the Account is created, for an indefinite term. The User may end it at any time by deleting their Account. The Author may end it in the event of a breach (Article 8), or by ceasing to provide the Software, with reasonable notice. Articles 6, 7 (for three years, see 7.4), 8 and 10 survive the end of the agreement under the conditions they set out.

Article 12 — Amendments

The Author may amend this agreement. The new version is presented in the Software and must be accepted to continue using it. It does not apply retroactively to obligations arising under an earlier version.

Article 13 — Governing law and disputes

This agreement is governed by French law. The parties will first seek an amicable solution. Failing that, the dispute will be brought before the competent courts.
